Terms and Conditions for Unreel Sessions:
Eligibility: By participating in Unreel Sessions, you acknowledge and agree to comply with these terms and conditions. Artists must be at least 18 years old and possess the necessary rights and permissions for the music they perform.
Application Process: To be considered for participation, artists must complete all required fields in the application form. Failure to provide accurate and complete information may result in disqualification.
Selection Process: The selection of artists for Unreel Sessions will be at the discretion of the organizers. The decision will be based on various factors, including musical talent, originality, and alignment with the platform's objectives.
Booking Fee: A non-refundable booking fee of $150 is required to secure a spot on Unreel Sessions and is non-transferable. This fee covers the administrative and production costs associated with organizing the live performances. The fee must be paid within [5 business days] from the date of acceptance into Unreel Sessions. Refunds will only be provided if Unreel Sessions cancels the event.
Additional Marketing Packages: Artists have the option to purchase additional marketing packages to enhance their promotions. Details and pricing for these packages will be provided separately. Payment for additional marketing packages is due as per the agreed-upon terms.
Rights and Permissions: By participating in Unreel Sessions, artists grant the organizers the right to record, film, and photograph their performances. Artists also grant permission for the recorded content to be used for promotional purposes on Unreel Sessions' online platforms and associated social media channels.
Intellectual Property: Artists retain all rights to their original music. However, artists grant Unreel Sessions a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and publicly display their performances for promotional purposes.
Usage Rights for Artists: Artists retain full ownership and usage rights of the media (recordings, films, and photographs) delivered by Unreel Sessions. Artists are granted permission to use the content for their own self-promotional purposes, including but not limited to personal websites, social media, and portfolios. However, artists are prohibited from providing the content to third parties for promotional purposes or commercial gain without prior written consent from Unreel Sessions.
Code of Conduct: Artists are expected to conduct themselves in a professional manner during their participation in Unreel Sessions. Any behavior that is deemed disrespectful, offensive, or in violation of local laws and regulations may result in disqualification and exclusion from future events.
Modifications and Cancellations: The organizers reserve the right to modify or cancel Unreel Sessions at any time for reasons beyond their control. In the event of cancellation, the booking fee will be refunded to the artists.
Limitation of Liability: The organizers of Unreel Sessions shall not be held responsible for any injury, loss, or damage incurred by artists or their property during their participation in Unreel Sessions.
Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Manitoba, Canada. Any disputes arising out of or in connection with Unreel Sessions shall be subject to the exclusive jurisdiction of the courts of Manitoba, Canada.
Payment Terms:
- Artists must submit the non-refundable booking fee of $150 within [5 business days] from the date of acceptance into Unreel Sessions.
- The payment must be made through [e-transfer, cash, PayPal, bank transfer], and proof of payment should be provided to the organizers.
Indemnification Clause: Artists agree to indemnify and hold Unreel Sessions, its organizers, affiliates, and partners harmless from any claims, liabilities, damages, losses, or expenses arising from their participation in Unreel Sessions, including but not limited to any copyright or intellectual property infringement claims related to their performances.
Duration of License: Artists grant Unreel Sessions a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and publicly display their performances for promotional purposes. This license shall remain in effect for a period of 5 years.
Confidentiality: Artists agree to treat any confidential information shared by Unreel Sessions during the application and participation process with utmost confidentiality. Confidential information includes but is not limited to trade secrets, financial data, and proprietary event-related information.
Image Release: Artists grant Unreel Sessions permission to use their names, likenesses, images, and any promotional materials related to their performances for advertising and promotional purposes related to Unreel Sessions.
Performance Requirements: Artists are required to deliver live performances with a minimum duration of [2 minutes] for each session. This minimum duration is set to ensure each performance provides a sufficient and substantial experience for the audience and fits the event’s schedule and structure.
Media Delivery Requirements: Artists shall deliver all recorded (instrumentals, song mix/mastered tracks) to Unreel Sessions no later than 7 days prior to the event. The media should be provided in WAV format via [email, file-sharing service]. This media will be used by Unreel Sessions to create all supporting materials, including but not limited to photos, videos, reels, graphics, and posters, for promotional purposes. Artists are responsible for ensuring the timely and accurate delivery of the media to facilitate the event's promotional activities.
Recording Quality: Unreel Sessions shall create all supporting media for the artists' songs, including but not limited to photos, videos, reels, graphics, and posters. Unreel Sessions will ensure that the media they produce meets a minimum quality standard, as determined by Unreel Sessions, to ensure suitable use for promotional purposes. If any specific technical requirements are necessary for the media, such as resolution or file format, artists will be notified by Unreel Sessions in advance.
Artists' Usage Restrictions: Artists are prohibited from manipulating, editing, or altering the media provided by Unreel Sessions in any way that may compromise its quality or misrepresent the artists' performances or Unreel Sessions as an event. The media shall be used by the artists solely for their own self-promotional purposes, adhering to the original form provided by Unreel Sessions.
Termination Policy: Both parties reserve the right to terminate their involvement in Unreel Sessions with written notice to the other party. In the event of termination, any obligations or liabilities incurred up to the termination date shall remain in effect. The organizers of Unreel Sessions may terminate the artist's participation if they violate the code of conduct or fail to comply with these terms and conditions.
Severability Clause: If any part of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in effect. In such cases, the parties will work together to replace the invalid or unenforceable provisions with new provisions that achieve the intended purpose.
By participating in Unreel Sessions, artists indicate their acceptance of these terms and conditions.
